Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The Gamesville Blog Heroes Contest (the "Contest") begins at 12:00:01 a.m. Eastern Time (ET) on October 22, 2009, and shall end as of 11:59 p.m. ET on October 28, 2009, (the "Contest Period") The Contest is sponsored by Gamesville c/o Lycos, Inc., 100 Fifth Avenue, Waltham, Massachusetts, 02451 ("Gamesville"). Submissions received after the Contest Period will not be judged. All winners will be announced on or about October 30, 2009. 1. ELIGIBILITY The Gamesville Halloween Costume Contest (the "Contest") is open to any Gamesville.com registered user who is at least 18 years old and a legal resident of the 50 United States or the District of Columbia logging onto the Internet from the United States. Employees, officers, directors, agents, representatives, and their immediate family (defined as parents, spouse, children, siblings, and grandparents) and household members, of Gamesville (collectively referred to herein with its parents, affiliates and subsidiaries as "Lycos") are NOT eligible to enter. It is not necessary to purchase any products or to subscribe to any paid Internet services in order to participate in the Contest. Void in Puerto Rico, Guam, all other U.S. or foreign territories or where prohibited or restricted by law. 2. TO ENTER Become a fan of Gamesville's Facebook page at http://www.facebook.com/gamesville on or before Wednesday, October 28th. Once you're a fan, post your Halloween costume photo to the fan photos section of the Gamesville page. Make sure to include your Gamesville member name so we know who you are. All submissions are due on Facebook by 6 p.m. ET on October 28, 2009. On October 29, 2009, the Gamesville panel of judges will review all the submissions and on October 30, 2009, will announce our winners on the Gamesville Blog at http://blog.gamesville.com. Decisions of the judges are final, and all entries become the exclusive property of Gamesville. 3. SELECTION AND NOTIFICATION OF POTENTIAL WINNERS Eligible entrants will be judged by a panel of three judges. The panel of judges will evaluate submissions in accordance with the criteria set forth below and their decisions are final and binding in all respects. Submissions will be judged using a 0-100 scale, with 0-35 points for originality and 0-35 points for creativity. 35 bonus points will be awarded for a costume that references Gamesville.com in some fashion. The three submissions with the highest overall point total will each be entitled to a prize, as set forth below, subject to verification of eligibility. Any physical prizes will be sent to winners via U.S. mail. If any prize is returned as undeliverable, prize will be forfeited and may be awarded to an alternate winner. Entrants grant Gamesville the right to use and publish their proper name and state of residence, online and in print, or in any other media, in connection with the Contest, or any promotions related thereto, unless prohibited by law. Acceptance of a prize constitutes permission for Gamesville and its advertising and promotional agencies to use winners' names, voices, and likenesses and any content contained in their submission for advertising and promotional purposes without additional compensation, unless prohibited by law. 4. PRIZES The following prizes will be awarded in this Contest: Grand prize winner, receiving the highest total combined score for the judges, will receive a DVD Box Set containing Season of NBC's "Heroes" Television show (approximate retail value $55.00). In addition, he or she will receive 10,000 GV Rewards (no cash value). First and second place winners, receiving the second highest and third highest total combined scores from the judges, respectively, will each receive 5,000 GV Rewards (no cash value). Prizes are not transferable. Substitution or cash redemption of prizes is not permitted, except by Gamesville, who reserves the right to substitute a prize of equal or greater value if the prize cannot be awarded for any reason. All taxes, fees and surcharges on prizes are the sole responsibility of winner. Limit one prize per person/email address for the entire Contest. NBC is not a sponsor of or affiliated with this Contest. 5. CONDITIONS The Contest is governed by these Official Rules. By participating, entrants agree to these Official Rules, and understand that the Contest's results are final in all respects. All decisions regarding the Contest, including, but not limited to, selecting potential winners and awarding prizes, will be made by Gamesville, whose decisions will be final and binding. Gamesville may prohibit any entrant from participating in this Contest or any future promotion if, at the sole discretion of Gamesville, such entrant (i) has tampered with the entry process or the operation of the Contest, (ii) repeatedly shows a disregard for the rules, or (iii) acts (a) in an unsportsmanlike manner, (b) with an intent to annoy, abuse, threaten, or harass Gamesville or any other entrant, or (c) in any other disruptive manner. The Contest, and all promotions relating thereto, are subject to all federal, state, and local laws and regulations. The Contest, and any promotions relating thereto, including the interpretation of these Official Rules, are governed by the laws of the Commonwealth of Massachusetts, and, by submitting an entry form, each entrant submits to the personal jurisdiction of that state. 6. LIMITATIONS OF LIABILITY Gamesville is not responsible for any incorrect or inaccurate information or entry of information, whether caused by users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest. Gamesville assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries. Gamesville is not responsible for any problems, errors or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, or software, or any failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Gamesville which corrupt the administration, security, fairness, integrity or proper conduct of the Contest, Gamesville reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and to randomly award the prizes from among all eligible entries received prior to such action being taken. Gamesville is not responsible for late, lost, illegible, incomplete, stolen, misdirected, damaged or postage due entries. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, GAMESVILLE RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. 7. INDEMNIFICATION AND RELEASE By participating in the Contest, and any promotions relating thereto, each entrant agrees to release and hold Gamesville and its respective parents, affiliates, subsidiaries, employees, officers, directors, agents, and representatives harmless from any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, either directly or indirectly related to or arising from the Contest or from acceptance, possession, misuse, or use of any prize. Each entrant further acknowledges that such parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee expressed or implied, in fact or in law, relative to the Contest or any prize, including but not limited to its quality or fitness for a particular purpose. 8. WINNER'S LIST The Official Winner's List will be posted at http://blog.gamesville.com for 60 days following the end of the Contest.
